CONDICIONES LEGALES DEL CONRATO DE ALQUILER DE BICICLETA ENTRE EL CLIENTE Y TWOFINEWHEELS

1. reserva, entrega y pago:

1.1 El pago del precio del alquiler y de los servicios complementarios se hace en el momento de efectuar la reserva.

1.2 El cliente recibe la(s) bicicleta(s) en perfectas condiciones técnicas. A partir de la entrega, el cliente es el único responsable de la(s) bicicleta(s).

1.3 Solo alquilamos previa presentación de un documento de identidad y nos reservamos el derecho a un depósito de seguridad si es necesario.

1.4 El cliente está obligado a reclamar cualquier defecto o daño al hacerse cargo de la(s) bicicleta(s). Los daños durante el período de alquiler deben ser informados de inmediato, y los costos incurridos para reparar los daños deben ser asumidos por el cliente.

2. cancelación y retirada:

2.1 Si se cancela una reserva hasta 30 días antes del inicio del período de alquiler, se reembolsará el 50% de los gastos de alquiler. Si cancela con menos de 30 días antes del inicio del alquiler, no habrá reembolso.

2.2 No se devolverá dinero si se cancela el alquiler durante el periodo contratado o si el cliente no se presenta.

3. devolución:

3.1 El período de alquiler se acuerda vinculantemente en el contrato. Si una bicicleta no se devuelve en el plazo acordado se deberá abonar una penalización de 200€. así como los gastos de seguimiento, como un alquiler posterior fallido.

3.2 Cualquier depósito que haya sido retenido será reembolsado si el artículo se devuelve limpio, incluidos todos los accesorios. Si se devuelve en un estado sucio e inaceptable, se pueden retener 10 € para la limpieza.

4. responsabilidad, daños, accidentes y robo:

4.1 El uso y las actividades deportivas, así como la participación en excursiones guiadas son bajo su propio riesgo. El cliente declara bajo su propia responsabilidad que está físicamente apto para participar en la actividad.

4.2 TwoFineWheels no se hace responsable de los daños causados al cliente o a terceros por el uso de la(s) bicicleta(s) y los accesorios.

4.3 El cliente es el único responsable del robo. El cliente se compromete a mantener siempre seguras la(s) bicicleta(s) y accesorios y nunca dejarlos desatendidos. Por la noche, la(s) bicicleta(s) y los accesorios deben estacionarse en una habitación segura y con cerradura. En caso de pérdida, el cliente deberá pagar el valor de reposición. Se calcula de la siguiente manera: 4.3.1 Bicicletas con menos de 18 meses: precio nuevo // 4.3.2 Bicicletas con más de 18 meses: 75% del precio nuevo // 4.3.3 El valor nuevo siempre para bicicletas en las categorías Premium, Premium+ y Club. Se puede consultar una lista de precios de las bicicletas bajo petición.

4.4 El cliente es responsable de los daños a la(s) bicicleta(s) y de los daños resultantes del uso a terceros y al propio conductor Los costes correrán a cargo del cliente en su totalidad y no están asegurados. Esto también se aplica a los daños de pintura.

4.5 El cliente acepta expresamente que los datos de la tarjeta de crédito puedan utilizarse para reparar cualquier daño. Todos los costes debidos a daños o robo deben pagarse en el momento de la devolución acordada.

5. otro:

5.1 NO OFRECEMOS SERVICIO EN CARRETERA

Le proporcionamos una bomba, herramientas y una cámara de aire para reparar una rueda pinchada, pero NO ofrecemos un servicio para recuperarlo a usted o a su bicicleta de regreso a nuestra tienda, sin importar qué tipo de daño ocurra.

Usted es responsable de que todas las bicicletas regresen a nuestra tienda dentro del período de alquiler acordado. ¡Usted acepta esto explícitamente al firmar el contrato de alquiler!

5.2 Se recomienda expresamente a los clientes la contratación de un seguro de responsabilidad civil y robo.

5.3 TwoFineWheels se reserva el derecho de cancelar la actividad o alquiler sin previo aviso y sin reembolso si el cliente se encuentra bajo la influencia de drogas y/o alcohol.

5.4 Si TwoFineWheels no dispone de una bicicleta reservada, se puede poner a disposición una bicicleta de repuesto de las mismas características como compensación. Cualquier diferencia de precio será reembolsada.

Jurisdicción:

Para cualquier controversia derivada del presente contrato, se acuerda la aplicación de la legislación española y la jurisdicción del tribunal competente - salvo que existan otras disposiciones imperativas en contrario.

 

ENGLISH: GENERAL CONDITIONS OF THE BICYCLE RENTAL BETWEEN THE CUSTOMER AND TWOFINEWHEELS

1. booking, delivery and payment:

1.1 The payment of the rental price and the additional services takes place when the reservation is made.

1.2 The customer receives the bicycle(s) in a technically perfect condition. From the handover, the customer has sole responsibility for the bicycle(s).

1.3 We only rent on presentation of an identity card or a driver's licence and reserve the right to keep a security deposit if necessary.

1.4 The customer is obliged to complain about any defects or damage when taking over the bicycle(s). Damage during the rental period must be reported immediately, and the costs incurred for repairing the damage must be borne by the customer.

2 Cancellation and withdrawal:

2.1 If a reservation is canceled up to 30 days before the start of the rental period, 50% of the rental costs will be refunded. If the cancellation less than 30 days before the start of the rental, there will be no refund.

2.2 No money will be refunded if the rental is interrupted or the customer does not show up.

3.Return:

3.1 The rental period is bindingly agreed in the contract. If a bike does not return within the agreed time a penalty of 200€ will have to be paid. as well as the follow-up costs, such as a failed subsequent rental.

3.2 Any deposit that may have been retained will be refunded if the item is returned in a clean condition, including all accessories. If returned in a dirty, unacceptable condition, €10 may be retained for cleaning.

4 Liability, damage, accidents and theft:

4.1 Use and sporting activities as well as participation in guided tours are at the customers risk. The customer declares on his own responsibility that he is physically able to take part in the activity.

4.2 TwoFineWheels is not liable for damage caused to the customer or third parties by the use of the bicycle(s) and the accessories.

4.3 The customer is solely liable for theft. The customer must always keep the bicycle(s) and accessories safe and never leave them unattended. At night, the bicycle(s) and accessories must be kept in a secure, lockable room. In the event of theft, the customer must pay the replacement value. This is calculated as follows: 4.3.1 Bicycles less than 18 months old: original price // 4.3.2 Bicycles older than 18 months: 75% of the original price // 4.3.3 Bicycles in the Premium, Premium+ and Club categories: always original price to pay. A price list of the bicycles can be consulted on request.

4.4 The customer is liable for damage to the bicycle(s) and consequential damage from use to third parties and the driver himself. The costs are to be borne in full by the customer and are not insured. This also applies to paint damage to the frame.

4.5 The customer expressly agrees that the credit card data may be used to settle any damage. All costs due to damage or theft must be paid by the time oft he agreed return date.

5.Other:

5.1 WE DO NOT OFFER ROAD SERVICE

We do supply you with a pump, tools and inner tube to fix a flat tyre, but we do NOT offer a service to retrieve you or the bike back to our shop, no matter which kind of damage occurs.

You are responsible that all bikes return to our shop within the agreed rental period. You explicitly accept this by signing the rental contract!

5.2 The customers are expressly recommended to contract a liability and theft insurance.

5.3 TwoFineWheels reserves the right to cancel the activity or rental without further notice and without refund if the customer is under the influence of drugs and/or alcohol.

5.4 If a booked bike is not available, a different bike with the same characteristics can be made available as compensation. Any price difference will be refunded.

Jurisdiction:

For any disputes arising from this contract, the application of Spanish law and the jurisdiction of the competent court is agreed - unless there are other mandatory provisions to the contrary.

GERMAN: GENERAL TERMS AND CONDITIONS FOR BIKE HIRE BETWEEN THE CUSTOMER AND TWOFINEWHEELS

1. booking, handover and payment:

1.1 Payment of the rental price and ancillary services shall be made upon reservation.

1.2 The Hirer shall receive the bicycle(s) in perfect technical condition. The hirer has sole responsibility for the bicycle(s) from the time of handover.

1.3 We only rent out on presentation of an identity card or driving licence and reserve the right to charge a security deposit if necessary.

1.4 The Hirer is obliged to report any defects or damage when taking over the bicycle(s). Damage during the hire period must be reported immediately and the costs incurred for repairing the damage must be borne by the hirer.

2. cancellation and termination/withdrawal:

2.1 If a reservation is cancelled up to 30 days before the start of the rental period, 50% of the rental costs will be refunded. In the event of cancellation less than 30 days before the start of the rental period, no refund will be made.

2.2 No money will be refunded if the rental is cancelled or not taken up.

3. return:

3.1 The rental period is bindingly agreed in the contract. If a bike is not returned within the agreed time, a penalty of €200 will be charged, as well as any subsequent costs, such as the cancellation of a subsequent rental.

3.2 Any deposit retained will be refunded if the equipment is returned in a clean condition, including all accessories. If the equipment is returned in a dirty, unacceptable condition, €10 may be retained for cleaning.

4 Liability, damage, accidents and theft:

4.1 The use and sporting activity as well as participation in guided tours is at your own risk. The hirer declares on their own responsibility that they are in good health to take part in the activity.

4.2 TwoFineWheels is not liable for damage caused to the renter or third parties through the use of the bicycle/bicycles and accessories.

4.3 The Hirer is solely liable in the event of theft. The Hirer undertakes to keep the bicycle(s) and accessories secure at all times and never to leave them unattended. At night, the bicycle/bicycles and accessories must be parked in a secure, lockable room. In the event of loss, the renter must pay the replacement value. This is calculated as follows: 4.3.1 Bicycles less than 18 months old: new price // 4.3.2 Bicycles older than 18 months: 75% of the new price // 4.3.3 For bicycles in the Premium, Premium+ and Club categories, the replacement value must always be paid. A price list of the bicycles can be viewed on request.

4.4 The Hirer shall be liable for damage to the bicycle/bicycles and consequential damage to third parties and the rider himself/herself resulting from their use. The costs are to be borne in full by the renter and are not insured. This also applies to damage to the paintwork on the frame.

4.5 The Hirer expressly agrees that the credit card details may be used to pay for any damage. All costs arising from damage or theft must be paid by the time of the agreed return.

5.other:

5.1 WE DO NOT OFFER A BREAKDOWN SERVICE

We will provide you with a pump, tools and an inner tube to repair a flat tyre, but will NOT provide a service to bring you or the bike back to our shop, regardless of the nature of the damage.

You are responsible for ensuring that all bikes are returned to our shop within the agreed hire period. By signing the hire contract, you expressly accept this!

5.2 Tenants are expressly recommended to take out liability and theft insurance.

5.3 TwoFineWheels reserves the right to cancel the activity or rental without further notice and without refund if the customer is under the influence of drugs and/or alcohol.

5.4 If a booked bike is not available, a replacement bike with the same characteristics can be provided as compensation. Any price differences will be refunded.

Place of jurisdiction:

For any disputes arising from this contract, the application of Spanish law and the jurisdiction of the competent court shall be agreed, provided there are no mandatory provisions to the contrary.
